These Terms and Conditions ("the Terms and Conditions") govern your ("the User") use of the Lady Fay’s Boudoir ("Provider") website located at the domain name www.ladyfays.co.za ("the Website"). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. Privacy Policy

The Website www.ladyfays.co.za sells sex toys online. The use of any product bought from this Website is at the User’s risk. The User indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

The private information required for executing the orders placed through the e-commerce facility, namely the User's personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.

The Provider undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. The Provider cannot be held responsible for security breaches occurring on the User's electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.


Delivery information

Subject to stock availability with suppliers and receipt of payment, goods are dispatched the day after an order has been placed unless this day falls on a public holiday, in which case, the goods will be dispatched on the next working day. Estimated delivery is calculated based on working days (this excludes weekends and public holidays) from the day that goods are dispatched, not from the day that goods are ordered. Goods are only dispatched once payment had been received by the Provider.

The Provider offers the User two alternative shipping options: The most economical option is regular post. Regular post means delivery to the post office of the User’s choice three to five days from time of dispatch.

The second, more expensive option is door to door with The Courier Guy where the package will be delivered to the User one weekday after dispatch. For this option, the User will need to supply the Provider with a physical address (not a post office box) and the User’s a contact phone number. Deliveries to outlying areas may take up to two days.

Please Note: Orders received after 12 noon may only be dispatched the following day and orders placed over the weekend may only be dispatched on Monday.

The Provider will supply all goods to the delivery company in good order and will ensure that goods arrive at the User's chosen delivery address in the same good order, however, the Provider cannot be held responsible for mistakes made by third parties at the post office. The Provider does however undertake endeavour to sort out problems should they arise

Cancelled orders on the e-commerce facility will be refunded after deduction of a 10% charge for administration costs. The Provider reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider's standards. Should the Provider exercise this right, the User will receive a full refund with no deductions.

Any complaints regarding the standard and quality of the product or products bought by consumers through the e-commerce facility should be directed to lady@ladyfays.co.za.


Returns Policy

In the interest of hygiene, the Provider is not able to accept returns or exchanges on intimate items. However, all products available on the Website are guaranteed against manufacturing faults as per the individual terms of the manufacturer. If the User has used a product and finds the product is damaged or faulty, the User many return the item to Lady Fay's Boudoir within 21 days of purchasing that item in all its original packaging. The product will then be sent to the manufacturer in the original packaging for assessment and based on the findings of the manufacturer; the item will be replaced or repaired, depending on the circumstance. For the period of time that the product is with the manufacturer assessment or repair, the User will be without a replacement item. However, if it is the finding of the manufacturer that the item should be replaced, the Provider will do so the moment the manufacturer makes this assessment.

To ensure that products are not used inappropriately, the User should follow the manufacturer’s instructions regarding care and use of the products. Products that are damaged by inappropriate use cannot be refunded or exchanged.


Export restriction

The offering on this website is available to South African clients and delivery addresses only, unless special arrangement is made before placing an order.


Payment Options

Payment may be made via Visa, MasterCard credit cards or by bank transfer into the Provider's bank account, the details of which will be provided after checkout.


Credit card acquiring and security

Credit card transactions will be acquired for the Provider via VCS who are the approved payment gateway for First National Bank. VCS uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Customer details separate from card details

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).


Responsibility

The Provider takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.


Updating of these Terms and Conditions

Provider reserves the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time.
